    Vraag:

    “Wat is de regelgeving betreffende masturbatie?”



    Antwoord:

    “Het gebruikmaken van masturbatie, en dit is het (seksueel) zelf bevredigen met de hand of iets anders, is Haraam (verboden)! Hiervoor is er bewijs in het Boek, de Soennah en de juiste overpeinzing.

    Wat het Boek betreft: door Allaah Ta’ala’s uitspraak:

    “En degenen die hun geslachtsdelen bewaken. Behalve tegenover hun echtgenotes en hun slavinnen, dan worden zij niet verweten. Maar wie meer dan dat wensen: zij zijn degenen die overtreders zijn.” [Soerah Al-Moeminoen Vers: 5-7]

    En degene die zijn seksuele behoeften bij een ander dan zijn vrouw of zijn slavin wil krijgen, die heeft meer dan dat gewenst en is dus een overtreder zoals deze Vers dat beaamt.

    Wat de Soennah betreft: door de uitspraak van Hem (salallaahoe 'alayhie was sallem):

    “O jullie jeugdigen, wie van jullie de mogelijkheid heeft om te trouwen die moet dat doen, want het staat bij in het neerslaan van de blikken en bewaken van de kuisheid. Wie hier niet toe bij machte is die moet vasten, want dit zal voor hem een bescherming zijn!” [Overgeleverd door al-Boechaarie en Moslim]

    Dus de Profeet (salallaahoe 'alayhie was sallem) gebood degene die niet bij machte is om te trouwen te vasten. Wanneer zelfbevrediging echter was toegestaan dan had de Profeet (salallaahoe 'alayhie was sallem) dit wel geadviseerd. Maar sinds de Profeet (salallaahoe 'alayhie was sallem) dit niet geadviseerd heeft -ondanks dat de (simpele) mogelijkheid hiertoe bestond- weet men dat het niet is toegestaan!

    Wat de juiste overpeinzing betreft: Dit is betreffende de vermeldingen van doktoren over de vele schadelijke gevolgen van deze handeling. Deze schadelijke gevolgen hebben effect op het lichaam, het instinctieve seksuele gevoel (behoefte), de gedachtegang, de organisatie (van iemands zaken) en misschien weerhoudt het hem zelfs van het werkelijke huwelijk! Want, als een persoon zijn gehele behoefte bevredigt met deze zaak dan kan het zijn dat hij niet meer omkijkt naar het huwelijk!”[1]

    HomoSexuality : Worse than Murder! – By Shaykh Abdul-Qaadir Al-Junayd (hafidahu Allah) :

    The proof that it is worse than murder is that Allaah has made the punishment of the murderer to be at the discretion of the heir. If he (the heir) wills then he is executed and if he wills then he pardons him. Whereas He has predetermined the execution of he who does the action of the people of Lut.

    The Imaam Al-‘Uthaymeen, may Allaah have mercy upon him, has said:

    As for the male having intercourse with (another) male then this is a great act of lewdness and a despicable crime. It is a corrupter of the Dunyaa and the religion. It is a destroyer of manners and an annihilator of manhood. It is corruption of the society and a killer of morality. It is cause for the vanishing of goodness and blessings and it brings about evil and iniquities. It is an axe of destruction and demolition. It is a cause for humiliation, disgrace, and shame. Enlightened minds abhor it and sound Fitrahs reject it. The divine legislations censure it and consider it an abomination. This is because the action of the people of Lut is a great harm and a vile form of oppression.

    For it is oppression to the one who does it, due to that which he has dragged himself to from disgrace and shame; and he has driven himself to that which contains death and destruction. It is also oppression to the one whom it is done to, for he has lowered and humiliated himself; and he is pleased with lowliness and degeneration for himself, as well as the annihilation of his manhood. For he is amongst men having the status of women; and there is a darkness of humiliation upon his face which will not be removed until he dies. It is oppression to the entire society due to that which it leads to from the unleashing of calamities and iniquities. Allaah has already narrated to us that which occurred to the people of Lut from punishment. He said, after He had informed us of the story of their death and destruction:

    وَمَا هِيَ مِنَ الظَّالِمِينَ بِبَعِيدٍ

    And they (the Punishments) are not ever far from the Zâlimûn (evil-doers). (Hud 11:83)

    When this despicable act spreads within the society and Allaah does not punish them by destroying their homes, then He unleashes upon them that which is worse than that. He unleashes upon them the inversion of the hearts, the twisting of their outlook, and the subjugation of their minds; such that they are silent about falsehood or their evil actions are beautified for them so that they deem them to be good!”

    The Ruling on Having Anal Sex with a Women, or During Her Menstrual Period, or Her Post-Natal Bleeding:

    Question:

    What is the ruling on having anal sex with a woman, or when she has her period, or when she has post-natal bleeding?

    Answer:

    It is not permissible to have sex with a woman in her anus, nor during her menstrual period, nor when she has past-natal bleeding. Indeed, this is one of the major sins, according to the Words of Allah, Mist High: They ask you concerning menstruation, Say: That is an Adha (a harmful thing for a husband to have a sexual intercourse with his wife while she is having her menses), therefore, keep away from women during menses and go not in unto them till they are purified (from menses and have taken a bath).And when they have purified themselves, then go in unto them as Allah had ordained for you (go in unto them in any manner as long as it is in their vagina).Truly, Allah loves those who turn unto Him in repentance and loves those who purify themselves (by taking a bath and cleaning and washing thoroughly their private parts and bodies for their prayers).Your wives are a tilth for you, so go to your tilth, when or how you will.[1]

    In this Verse Allah, Most Glorified,has made clear the obligation to avoid women during their menstrual periods. He forbade approaching them until they are purified. This proves the prohibition of having sexual intercourse during their menstrual periods. Post-natal bleeding is the same as that. So when they become purified by complete ablution (ghusl), it is permissible for the husband to have sex with her in the way which Allah commanded. That is to have sex with them in front (i.e., the vagina) and that is the place where one ploughs (i.e., plants seeds).As for the anus, it is a place of harm and feces, and it is not the place for planting seeds. Therefore, it is not permissible to have sex with the wife in her anus. Indeed, that is one of the major sins, and it is well known to be an act of disobedience to the purified Islamic Law. Abu Dawud and An-NisaýI have reported from the Prophet-Sallallahu alaihi wasallam- that he said: Cursed is the one who has sex with his wife in her anus. [2]

    At-Tirmithi and An-Nasaýi reported on the authority of Ibn Abbas, may Allah be pleased with him, from the Prophet -Sallallahu alaihi wasallam- that he said: Allah will not look at a man who had sex with a man or women in the anus. [3] And its chain of narrators is authentic .Having anal sex with a woman is from Al-Liwat, which is forbidden to both men and women. And Allah, Most Glorified.Most High says about the people of Lut,peace be upon him: You commit Al-Fahishah (sodomy-the worst sin) which none has preceded you in(committing) it in the Alamin ( mankind and jinn), [4]

    And the prophet- Sallallahu alaihi wasallam- said: Allah curses the one who performs the actions of the people of Lut. [5] He said it three times.Narrated by Imam Ahmed with an authentic chain of narrators. So it is incumbent upon all the Muslims to be on their guard against this sinful deed, and it is necessary for the wives to avoid it, and not allow their husbands to commit this great sin. That is, sexual intercourse during the menstrual period, during post-natal bleeding, and sex via the anus. We ask Allah to protect the Muslims and keep them safe from everything which opposes His purified Law, for He is the best One to ask.

    The Ruling on Having Anal Sex With a Wife;

    Question:

    A man asked his wife to have sex with her in her anus, is this action correct from the religious point of view?


    Answer:

    This deed is forbidden, for it is reported by Abu Dawud and others that the Prophet (sallallaahu alaihi wa sallam) said: Cursed is the one who has sex with his wife in her anus. [1]

    Atonement for Having Anal Intercourse:

    Question:

    What is the ruling on having anal intercourse? And is there any atonement incumbent upon one who does so?

    Answer:

    Anal intercourse with a woman is a major sin and a repugnant act of disobedience, according to the confirmed narration from the Prophet - Sallallahu Alaihi wasallam - in which he said: Allah will not look at a man who had sex with a man or women in the anus. [1] It is incumbent upon one who does that to hasten to repent to Allah. That means to abandon the sin and leave it in glorification of Allah and in order to avoid His Punishment. He must also show remorse for what has passed of that (sin) and to make the honest intention not to repeat it, along with an effort to perform many good deeds.

    And whoever repents honestly to Allah, Allah will turn to him with forgiveness and pardon his sins, as He says: And Verily, I am indeed forgiving to him who repents, believes (in My Oneness, and associates none in worship with Me) and does righteous good deeds, and then remains constant in doing them (till his death)[2] He, the Almighty, the All-Powerful says: And those who invoke not any other ilah (god) along with Allah, nor kill such persons as Allah has forbidden, except for just cause, nor commit illegal sexual intercourse ý and whoever does this shall receive the punishment . the torment will be doubled to him on the Day of Resurrection, and he will abide therein in disgrace, Except those who repent and believe (in Islamic Monotheism), and do righteous deeds, for those, Allah will change their sins into good deeds, and Allah is Oft-Forgiving, Most Merciful.[3] The Prophet - Sallallahu alaihi wasallam - said: Islam wipes out what was before it, and emigration wipes out what was before it. [4]

    The Verse and Hadiths bearing this meaning are numerous. There is no atonement for one who has anal intercourse, according to the most correct of two opinions held by the scholars. Nor does his wife become forbidden to him due to it, rather she remains in his custody. She should not obey him in this great sin; rather she should prevent him from doing so and seek an annulment of her marriage if he does not repent. We ask Allah to protect us from that.

    From the Joys of Paradise: Sexual Intercourse! :


    In the Name of Allaah, the Most Merciful, the Ever Merciful…

    Allaah, the Most Generous, has promised His believing servants many different rewards in His expansive gardens of Paradise. Aside from the greatest joy of all, looking at our Magnificent Creator, the residents of Paradise will indulge in various foods an drinks, to the large homes, rivers of pure water, honey, milk, and wine, to the beautiful virgin girls awaiting the personal enjoyment of the men.

    Deviant Modernists Second Guess Allaah’s Divine Wisdom:

    Recently, philosophical attempts have been made to rationalize some of these rewards and second guess the Divine decree of Allaah, as deviants begin picking and choosing what is acceptable from Allaah’s perfect Wisdom and what is not. Some people – affected by a Christian understanding of the Hereafter – have actually begun denying some of the things promised by Allaah in His Book and explained in detail by the Messenger of Allaah (may Allaah raise his rank and grant him peace), like continual acts of sexual intercourse with the hoor ‘een (pure virgin maidens) of Paradise.

    Christian Influence:

    According to both modern and ancient Christian misconceptions revolving around the “dirty” and “disgraceful” nature of legal sexual intercourse, they believe that it is not the ambition of an upright person. Based on this, they exonerate their religious leaders above such a lowly concept in this life, and they reject the ”repulsive” concept of sexual pleasures in Paradise. In the Hereafter, they deny any type of sexual intercourse, claiming that Paradise is a “pure place” above such animalistic notions.

    Islam Recognizes Human Nature:

    Islam, on the other hand, is balanced. Our Lord has created us with instincts and inclinations. He has not forbidden people from enjoying themselves in legal intercourse with their spouses in this life, nor has He attached any blame to them for that. He has forbidden harmful acts of transgression like fornication, adultery, and homosexuality, yet He has allowed even the most pious of His servants to indulge in sexual intercourse with their spouses, with no harm or blame associated with that.

    In the Hereafter, Allaah has prepared gardens of delight, with sexual partners waiting for the believers. Women will enjoy the very best and most pleasing acts of sexual intercourse with their handsomely attractive husbands, at the peak of their youth and vigor. Men will enjoy their wives from this life, in addition to the many voluptuous hoor ‘een (pure virgins) awaiting them.

    Sex in Paradise = Tabloid Mentality?:

    The repeated pleasures of of sexual intercourse in Paradise is not a “filthy idea” or a “tabloid” concept, nor is to be mocked or ridiculed, as the non-Muslims may often do. Allaah, the Most Wise, calls the believers to Paradise by mentioning descriptions of the beautiful women awaiting them in Paradise. The belief in ongoing, continuous acts of absolutely joyful sexual intercourse in Paradise is something that the entire body of Muslims (scholars and laymen) have always held as unquestionable.

    By Allaah’s Permission, this short article provides clear proof of this from Islamic textual evidences, in order to aid those who have been affected by popular speakers who seem to be specialists in opposing the ijmaa’ (scholarly consensus) of the whole Muslim ummah and leading the Muslims into confusion and misguidance!

    Authentic Texts on the Topic:

    In fact, there are many Prophetic narrations from a number of Companions that clearly and unequivicolly affirm the concept of sexual intercourse in Paradise. The following collection of hadeeths and narrations of the Companions and early scholars of Islam proves this fact with abundant clarity.

    -1- Anas ibn Maalik (may Allaah be pleased with him) narrated that the Messenger of Allaah (may Allaah raise his rank and grant him peace) said:

    يُعْطَى المُؤْمِنُ فِي الجَنَّةِ قُوَّةَ كَذَا وَكَذَا مِنَ الجِمَاعِ

    “A believer in Paradise will be given the stamina to have sexual intercourse such-and-such (number of times).”

    Anas said, “O Messenger of Allaah! (How) will he have the ability to do so?”

    He replied:

    يُعْطَى قُوَّةَ مِائَةٍ

    “He will be given the stamina of one hundred (men).”

    Collected by at-Tirmithee (#2536) and others. At-Tirmithee authenticated it, as did Ibn al-Qayyim in Haadee al-Arwaah (p.232) and Al-Albaanee. At-Tirmithee entitled the chapter: “What Has Been Reported About the Sexual Intercourse of the People in Paradise.”

    -2- Zayd ibn Arqam (may Allaah be pleased with him) narrated that a Jew came to the Prophet (may Allaah raise his rank and gant him peace) and said, “O Abal-Qaasim! Don’t you presume that the people of Paradise shall eat and drink there?!”

    He replied:

    بَلَى وَالَّذِي نَفْسِي بِيَدِهِ، إِنَّ أَحَدَهُمْ لَيُعْطَى قُوَّةَ مِائَةِ رَجُلٍ فِي الْمَطْعَمِ وَالْمَشْرَبِ وَالشَّهْوَةِ وَالْجِمَاعِ

    “Nay, (I swear) by the One in whose Hand is my soul! Surely, one of them will have the stamina of a hundred men with regards to eating, drinking, desires, and sexual intercourse.”

    It was collected by Ahmad (4/367, 371) and others with an authentic chain. Ibn al-Qayyim authenticated it in Haadee al-Arwaah (p.187), as did Al-Albaanee in Saheeh at-Targheeb (#3739).

    -3- Aboo Hurayrah (may Allaah be pleased with him) asked the Prophet (may Allaah raise his rank and grant him peace), “O Messenger of Allaah! Are we going to approach our wives (for sex) in Paradise?”

    He replied:

    إِي وَالَّذِي نَفْسِي بِيَدِهِ، إِنَّ الرَّجُلَ لَيُفْضِي فِي الْغَدَاةِ الْوَاحِدَةِ إِلَى مِائَةِ عَذْرَاءَ

    “Yes, (I swear) by the One in whose Hand is my soul! Surely a man will approach one hundred virgins in a single afternoon!”

    It was collected by at-Tabaraanee in al-Mu’jam al-Awsat (#718). ad-Dhiyaa’ al-Maqdisee authenticated it according to the standards of Muslim, as quoted in It-haaf al-Jamaa’ah (3/268) of at-Tuwayjiree.

    Some scholars mention that this narration is more correctly attributed to Ibn ‘Abbaas, not Aboo Hurayrah. Refer to al-‘Ilal al-Waaridah of ad-Daaraqutnee (10/30).

    In another version of Aboo Hurayrah’s narration:

    نَعَمْ وَالَّذِي نَفْسِي بِيَدِهِ دَحْماً دَحْماً؛ فَإِذَا قَامَ عَنْهَا رَجَعَتْ مُطَهَّرَةً بِكْرًا

    “Yes, (I swear) by the One in whose Hand is my soul, orgasm after orgasm; and when he gets up, she returns to being a pure virgin.”

    This version was authenticated by al-Albaanee in Silsilat al-Ahaadeeth as-Saheehah (#3351).

    In another version collected by Is-haaq ibn Raahawayh (#345) and al-Bazzaar (16/243) in their Musnads:

    نَعَمْ، بِذَكَرٍ لَا يَمَلُّ، وَفَرْجٍ لَا يُجْفَا، وَشَهْوَةٍ لَا تَنْقَطِعُ

    “Yes, with a penis that does not tire, a vagina that does not dry up, and a desire that does not cease.”

    Al-Bazzaar mentions that this version is not authentic, as does al-Haythamee in Majma’ az-Zawaa’id (10/417). However, it can be supported by the generality of these narrations, as well as the upcoming narration of Aboo Umaamah specifically.

    -4- Ibn ‘Abbaas (may Allaah be pleased with him) is also reported to have narrated the previous hadeeth about one hundred virgins in one afternoon, as mentioned.

    It was collected by Aboo Ya’laa in his Musnad (#2436). This report appears to have a weak (unauthentic) chain of narration.

    -5- Aboo Umaamah (may Allaah be pleased with him) said that the Prophet (may Allaah raise his rank and grant him peace) was asked if the people of Paradise will indulge in sexual intercourse, and he replied:

    نَعَمْ، بِذَكَرٍ لَا يَمَلُّ، وَشَهْوَةٍ لَا تَنْقَطِعُ دُحْمًا دُحْمًا

    “Yes, with a penis that does not tire and desires that do not cease, orgasm after orgasm!”

    It was collected by at-Tabaraanee in his al-Mu’jam al-Kabeer (8/160, 172) and others. Although its chain is weak, Al-Albaanee authenticated it based on support from other narrations in Silsilat al-Ahaadeeth as-Saheehah (7/1062).

    -6- The scholars of Tafseer (Quranic Exegesis), beginning with the Companions, like ‘Abdullaah ibn ‘Abbaas and ‘Abdullaah ibn Mas’ood, and the Taabi’oon and later scholars, the likes of Sa’eed ibn al-Musayyab, ‘Ikrimah, al-Hasan al-Basree, Qataadah, and many others, have explained the following Verse:

    إِنَّ أَصْحابَ الْجَنَّةِ الْيَوْمَ فِي شُغُلٍ فاكِهُونَ

    ( Verily, the people of Paradise that Day shall be occupied, rejoicing ) [36:55]

    They said: “Occupied with taking the virginity of virgins (through sexual intercourse).”

    -7- The four well-known imaams – Aboo Haneefah, Maalik, ash-Shaafi’ee, and Ahmad (may Allaah have Mercy on all of them) – all held the position that the people of Paradise will enjoy sexual intercouse from the many joys of Paradise.

    -8- The entire body of the scholars of the Salaf unanimously agreed that the people of Paradise will indulge in sexual intercourse. In fact, some of the scholars declared a person who would reject any one of the textually established pleasures of Paradise to be a disbeliever.

    Al-Waa’ith as-Salamaasee (d.550) said:

    فمن خالف شيئاً من هذا فقد خرج عن الإسلام بخلافه القرآن والسنة والإجماع

    “Anyone who opposes any of these things [from them: sexual intercourse in Paradise] has left Islam, due to his contradiction to the Qur’aan, the Sunnah, and scholarly consensus.”

    Pas op dat je jezelf niet dichtbij de toiletten begeeft! O mijn broer ! Hoe? Hoe kun jij deze viezigheid toestaan? ALLAH heeft jou een reine plaats gegeven en jij gaat in de plaats van onzuiverheden?

    Weet je dat de sexe van je echtgenote rein is- behalve op het moment wanneer zij menstrueert. Zelfs de witte vloeistof die zij afscheidt is rein. Geen enkel verwijt ( te maken) wat betreft de (gebruikte) termen, want zij zijn nodig. En jij verlaat het reine?

    Ayoub as Shiktiyani rahimahuLLAHu te 3ale heeft gezegd: "Ik vlucht voor het - dwz de uitwerpselen - wanneer ik het van ver zie, dus hoe kan zijn opening binnengaan. Hoe kan ik zijn opening binnengaan! Vrees ALLAH ! Laat dat achterwege o mijn broer. Je hebt ( daarvoor ) een schone plaats gekregen !

    Waar is de properheid die jij pretendeert? Terwijl jij je in een onreine plaats begeeft en laat de reine weg die ALLAH jou heeft toegestaan ! Diegene die dat doet, er zijn er ( van de mensen der kennis) die de doodstraf hierop oordelen, zoals het volk van Lot ( werd uitgeroeid).

    Maar, het meest authentieke is dat hij berispt wordt naast (het gedood worden). En wat enkelen zeggen dat hij zijn vrouw gescheiden is van hem : dat woord is niet authentiek.

    Maar, aan de andere kant, hij moet worden opgevoed en berispt. Dat de moslim uitkijkt voor deze viezigheid en deze gelijkenis. Diegene die een volk imiteert hij behoort tot hen.

    Hetzelfde geldt voor als ( de moslim) komt in haar mond ! O mijn broeders ! Blijf weg van deze films, blijf weg van deze beruchte scenes ! Jullie zijn gemaakt voor een groots iets als je daar je aandacht op richt. Behoed jezelf en verhoog jezelf door niet te grazen met de zwakken van geest. O mijn broeder ! Vrees ALLAH in jezelf !

    Trouwens, de broeder zegt dat de fatawas hierover uiteenlopend zijn. Nee, bij ALLAH, zij zijn niet uiteenlopend. Wie is degene die jou een fatwa heeft gegeven dat het toegestaan is ? Hoe kom je erbij dat er meningsverschil over is ? Dat is een meningsverschil waar geen rekening mee wordt gehouden. Niet met alle meningsverschillen wordt rekening gehouden, behalve wanneer het gaat om een meningsverschil die het waard is om onderzocht te worden. En wees voorzichtig om geen misleidende fatwas te nemen die je op een dwaalspoor brengen en deze ( die dat zouden toestaan) maken daar deel van uit.

    Wees voorzichtig o dienaar van ALLAH ! Wees rein! Wees rein ! Wees zuiver en maak zuiver ! Verwijder je van deze viezigheden ! Jij, zou je urineren in haar mond? Hoe? Wij vragen aan ALLAH om veiligheid !

    Ik stel voor aan degene die (dit antwoord) hoort, ik stel voor aan degene die dit met haar doet, dat hij drie maal op haar spuugt , vertrekt en laat voor wat het is. Het is alleen een voorstel; het is geen fatwa, het is meer om de woede ( hier te laten zien).

    Pas op mijn broer ! En aan de moslimvrouw om hem niet deze walgelijke handelingen toe te staan ! Houd jullie ver weg van het imiteren van ongelovigen ! "Degene die een volk imiteert hij hoort dan tot hen."

    Ik vraag ALLAH , de Vrijgevige, bij Zijn Mooiste Namen en Verheven Eigenschappen, Heer van de Geweldige Troon, dat hij voor ons en jullie onze Religie beschermd en dat hij de Moslims op een mooie manier naar hun Religie doet terugkeren en dat hij hen houdt van begeerten en twijfels. Tevens vragen wij hem Tabaraka wa Te aala een nuttige kennis en vrome daden.

    The Permanent Committee for Scholarly Research and Ifta' had perused the letter submitted to the Grand Mufty by the chairman of Al-Dhayd Legal Court in the UAE under no. 289/1 on 19/8/1420 A.H. which was referred to the General Secretariat of the Council of Senior Scholars under no. 5599 on 20/11/1420 A.H., in which His Eminence asked some questions. After the Committee has reviewed the questions, its answer comes as follows:

    What is the ruling on bestiality?

    Answer:

    The ruling on bestiality and its consequences:

    Having sex with animals is a bad deed, transgression to bounds set by Allah and contradicts the Fitrah (natural disposition) with which a man was created. Allah (Glorified be He) does not allow people to have sex except with one's wife or slave girl. He (Exalted be He) says, And those who guard their chastity (i.e. private parts, from illegal sexual acts) Except from their wives or (the slaves) that their right hands possess, - for then, they are free from blame; But whoever seeks beyond that, then those are the transgressors; Those who commit this must repent, seek Allah's forgiveness and not to do it again in the future.

    If the judge has proof that a person had sex with animal, he should deter him with a punishment in order for him not to do it again.

    As for the beast, it must be killed in all cases and it is not permissible to eat its meat. If the beast is his, no compensation will be paid but if it is owned by another person, the doer will pay a compensation for it to the owner. A group of scholars see that killing the beast helps in forgetting the crime and so that people will not remember it whenever they see it.

    May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.

Afterwards, they manumit the slaves in order to avoid having any unlawful relations with these girls. What is the ruling on this action? Are there any slaves nowadays?

    Answer:

    It is not permissible to sell free people, and if there is a country that sells free people as slaves, this does not actually make them slaves. They are free people and it is not permissible to sell them, buy them, or have intercourse with them. May Allah grant us success.     In de laatste fatwa word er gezegd dat (gezien) er geen slavenmarkt is men er ook geen slaven kan kopen om er dan sex mee te hebben. Of versta ik dat verkeerd. Ik kan zo moeilijk geloven dat in de tijd van de profeet vzmh er werd verkondigd/begrepen dat je sex mocht hebben met de slavin. Dus een vrouw kon sex hebben met haar man of haar meester? (Oorsprong SM?) of was er dan sprake van een tijdelijk? Huwelijk tussen slavin en meester

    Ik denk dat de slavinnen van toen ook behoeftes hadden. En iemand moest die toch bevredigen lijkt mij ??!!

    Zoals ik al eerder uitlegde, het staat in de Edele Koran, het ware Woord van onze Schepper, Allah subhanahu watahala, dat sex is toegestaan tussen de rechtmatige eigenaar en zijn slavin (een concubine), conform de authentieke sharia (uit bv noodzaak/noodgedwongen en of prangende behoeftigheid). Wa Allahu ahlem. Mensen werden destijds, i.c. de tijd waarin de Profeet, vrede en zegeningen zij met hem, nog leefde als vb, buitgemaakt tijdens oorlogen en meegevoerd naar het thuisland. Hun nakomelingen worden dan als slaaf beschouwd.Zie onderstaande fatawa. Wa Allahu ahlem.Je kan sadomasochisme dus totaal niet hiermee vergelijken of overeenkomsten in vinden, noch beschouwen als iets conform de authentieke sharia!Toegestane rechtsgeldige sex is alleen mogelijk binnen: ofwel een rechtsgeldig shariahuwelijk én/of als concubine conform de authentieke sharia, aldus de dragers van kennis. Een tijdelijk huwelijk ofwel genotshuwelijk is dus niet toegestaan, aldus de dragers van kennis. Wa Allahu ahlem.Insha Allah is het zo nader verduidelijkt voor je meis. Ghair insha Allah!

    This is how a believer purifies himself through his submissive obedience to Allah (Exalted be He) and His Messenger (peace be upon him). In addition, he purifies his wealth through paying obligatory Zakah. Then, Allah (Glorified be He) further says: And those who guard their chastity (i.e. private parts, from illegal sexual acts) Except from their wives or (the slaves) that their right hands possess, - for then, they are free from blame; Believers guard their chastity from illegal sexual acts except from their wives or the slaves that they possess. Likewise, female believers guard their chastity from illegal sexual acts except from their husbands or master if she is a slave girl. Whoever practices Zina (premarital sexual intercourse and) or sodomy or has anal sex with a woman, or has sex with a woman while she is having her menstrual period or postpartum period or masturbates and does not guard his chastity from illegal sexual acts will become a transgressor (oppressor). Believers use to have normal sex with their wives when they are free from menstruation or postpartum period and not in a state of Ihram (ritual state for Hajj and `Umrah). Moreover, they have sex with them in the legally permissible times for such relations.


    Surah al Nur:24:32:

    The Noble Ayah (Qur'anic verse), the Mufty quoted, is stated by Allah (Glorified and Exalted be He) after His Saying: And marry those among you who are single (i.e. a man who has no wife and the woman who has no husband) and (also marry) the Sâlihûn (pious, fit and capable ones) of your (male) slaves and maid-servants (female slaves). If they be poor, Allâh will enrich them out of His Bounty. And Allâh is All-Sufficient for His creatures’ needs, All-Knowing (about the state of the people). Then He (Exalted be He) says: And let those who find not the financial means for marriage keep themselves chaste, until Allâh enriches them of His Bounty.


    The word Ayama (singles) is used to refer to the woman who has no husband and the man who has no wife whether he married before and then separated or neither of them married before, as quoted by Al-Jawhary from the linguistics. Allah's Saying (Exalted be He): If they be poor, Allâh will enrich them out of His Bounty. `Aly ibn Abu Talhah reported from Ibn `Abbas (may Allah be pleased with him and his father) that Allah urged them to marry and ordered the free and slaves to do so and promised to enrich them by saying: If they be poor, Allâh will enrich them out of His Bounty. Ibn Abu Hatim said that Mahmud ibn Khalid Al-Azraq reported from `Umar ibn `Abdul-Wahid from Sa`id ibn `Abdul-`Aziz that he said: "I was informed that Abu Bakr Al-Siddiq (may Allah be pleased with him) said, 'Obey Allah with regard to His Command to you concerning marriage and He will fulfill His Promise to enrich you.' Allah (Exalted be He) says: If they be poor, Allâh will enrich them out of His Bounty. (Related by Ibn Jarir) It is mentioned by Al-Baghawy from `Umar and Al-Layth from Muhammad ibn `Ajlan from Sa`id Al-Maqbury on the authority of Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace be upon him) said: Al-Tirmidhy, Sunan, Book on the merits of Jihad, no. 1655; Al-Nasa'y, Sunan, Book on Jihad, no. 3120; Ibn Majah, Sunan, Book on judgments, no. 2518; and Ahmad ibn Hanbal, Musnad, vol. 2, p. 437.There are three who are entitled to Allah's Help: the one who gets married, seeking chastity, the slave who made a contract of manumission with his master to buy his freedom, and the Mujahid (one striving or fighting in the Cause of Allah)." (Related by Imam Ahmad, Al-Tirmidhy, Al-Nasa'y and Ibn Majah).

    Zakah:

    The fifth category includes the freeing of slaves and captives of war: Zakah is to be given to slaves so that they can set themselves free from the bondage of slavery. In this regard, Zakah is given to the type of slaves known as Mukatabs (slaves with an agreement to buy their freedom). According to the correct view, one who delivers Zakah may buy slaves with the money of Zakah for the purpose of freeing them. It is also permissible that he uses the money of Zakah in buying Muslims who have fallen captive to the Kafirs (disbelievers). Thus Zakah is delivered to the Kafirs as a ransom to release the Muslim captives.

What is the ruling on a person purchasing a female slave from a Muslim warrior who has taken her as a prisoner of war from Dar-ul-Harb (enemy territory)?

    Answer:

    First, it is permissible for the Muslim to marry a woman from the People of the Scripture - a Christian or a Jew - if she is a chaste woman. The basic evidence for this permissibility is the Saying of Allah (Exalted be He), Made lawful to you this day are At-Tayyibât [all kinds of Halâl (lawful) foods, which Allâh has made lawful (meat of slaughtered eatable animals, milk products, fats, vegetables and fruits)]. The food (slaughtered cattle, eatable animals) of the people of the Scripture (Jews and Christians) is lawful to you and His Saying, ...and chaste women from those who were given the Scripture (Jews and Christians) before your time when you have given their due Mahr (bridal-money given by the husband to his wife at the time of marriage), desiring chastity (i.e. taking them in legal wedlock) not committing illegal sexual intercourse, nor taking them as girl-friends.(Surah Al-Ma'idah).

    In Arabic the word Muhsanat (casually translated in the Ayah as 'chaste women' ) implies the qualities of chastity and freedom. As regards the Saying of Allah (Exalted be He), And do not marry Al-Mushrikât (idolatresses, etc.) till they believe (worship Allâh Alone). , it is about the idolatress women and not the women of the People of the Scripture; because the Qur'anic Ayah from Surah Al-Ma'idah is clear about the lawfulness of marrying women from the People of the Scripture.

    Second, the basic source for slavery is prisoners of war who are captured by Muslims through wars between them and the unbelievers and through Jihad (fighting in the Cause of Allah) to make the word of Allah (Exalted be He) superior and to defend His Religion. This status applies to the descendants who are born into slavery and they cannot be released except through manumission. On the other hand, kidnapping free persons to be sold into slavery is not permissible. Also, it is not permissible for a Muslim to enslave another Muslim captured through wars between Muslims or to sell a free Muslim. None of this is permissible and it is even unlawful; it does not prove ownership of the slave in question. If enslavement takes place through the legal means we mentioned, it is permissible for the Muslim to purchase slaves, which includes female slaves as mentioned by the questioner.

    Answer:

    Slavery is originally to capture non-Muslim prisoners of war during wars that take place between Muslims and Non-Muslims and Jihad for the sake of raising Allah's Word and supporting His Din (religion).

    All other forms of slavery are impermissible such as that slavery which takes place without war or Jihad but through kidnapping free people, enslaving Muslims during wars between Muslim countries, or the selling of free people. The foregoing are all Haram (prohibited) forms of slavery through which ownership is not established. The conditions of validity of slavery along with the answers for questions no. 1, 2, 3, and 5 can be known through the consideration of the details mentioned above. May Allah grant us success.     Question:

    A Muslim young man, who I consider to be good and well mannered, has proposed to my sister, but he does not have the basic requirements for maintaining a home. Please bear in mind the following:

    1. My family requests him to secure nothing more than food, accommodation and clothing.They were not even specific as regards how these things should be secured.
    2. He has no disability that hinders him from keeping a permanent job.
    3. He is 21 years old.

    My question is: Is it permissible to reject this marriage proposal as he is unable to bear the responsibility of maintenance expenses? It is noteworthy that he memorizes the Qur'an, is religiously committed and has a good character. Kindly, answer me as soon as possible as I fear disobeying the Prophet (peace be upon him) who said, If someone with a satisfactory standard of faith and good conduct comes to you seeking marriage, then give him (your daughter or sister) in marriage... My father left me in charge of my sisters' marriage, so I am keen to marry them to people who will not cause any problems or embarrassment to my father.

    Answer:

    If the reality is as you have mentioned, being a poor suitor may not be an impediment that prevents him being accepted as a husband for your sister as long as she gives her consent. Allah (Exalted be He) will enrich him out of His Bounty, as He says, And marry those among you who are single (i.e. a man who has no wife and the woman who has no husband) and (also marry) the Sâlihûn (pious, fit and capable ones) of your (male) slaves and maid-servants (female slaves). If they be poor, Allâh will enrich them out of His Bounty. And Allâh is All-Sufficient for His creatures’ needs, All-Knowing (about the state of the people). May Allah grant us success.     Please be advised that I had a female slave. When the government began to compensate slave owners, I exchanged her for money and she became free.This slave was married while she was mine. Is she lawful for her husband now, having been bought and sold, or is she considered divorced? Appreciate your guidance, may Allah reward you in this world and in the Hereafter.

    Answer:

    Wa `alaykum as-salam warahmatullah wabarakatuh.

    If the reality is as you mentioned, this slave is still married to her husband; selling and freeing her does not nullify their marriage. However if her husband is also a slave and she has been set free, she has the choice whether to stay with him or leave him, according to what was mentioned in the following Sahih (authentic) Hadith on the authority of `Aishah (may Allah be pleased with her) that she bought a slave girl called Barirah and freed her. She was married at that time, so the Prophet (peace be upon him) gave her the choice whether to stay with him or leave him.
