Shaych Mohammed bin Saalih al-`Othaymien (رحمه الله) werd het volgende gevraagd:


Vraag:

Wat is de regelgeving omtrent het gebruik van een puffer tegen astma?


Antwoord:

Het gebruiken van een puffer ter genezing van astma terwijl een persoon aan het vasten is tijdens ramadan of buiten de ramadan om, daar is niets mis mee.

Want (het gas uit) deze puffer bereikt de maag (waar het eten en drinken samenkomt) niet. Het enige wat deze puffer doet is het openen van de luchtwegen en bereikt de maag niet. Er is dus niets mis mee.

Question:

I want to stop smoking and I ask Allah to help me achieve this goal. My question is:

There is a patch placed on the arm which helps the smoker to get over the difficulty of stopping smoking. Is it allowed to use this patch during Ramadan, taking into consideration that this patch automatically produces the nicotine substance whenever the body needs it? Please provide me with the answer, may Allah reward you well.

Answer:

We ask Allah to guide you to repent from the habit of smoking and to help you stop, since it is extremely harmful and has no good at all. As for your question with regard to the permissibility of using a patch which is stuck to the arm and helps you stop smoking, and whether is it permissible for you to use it during Ramadan while you are fasting or not, our answer is that it is not permissible for you to use that patch, since we have asked the specialists about this patch and they said that it provides the body with nicotine that reaches the blood. Therefore, this will invalidate fasting the same way smoking does, because the effect of both is the same. On the other hand, you should have a strong determination to stop smoking by another means, since there are many people who repented and stopped smoking without using this patch. Remember that whoever abandons something for the sake of Allah, He will replace him with something better than it.

Question: Asthmatics inhale some of their medications, does this invalidate their Sawm (Fast)?

Answer: The Committee gave the following answer:

Asthma medication which a sick person inhales reaches the lungs through the windpipe and does not reach the stomach. It does not constitute food or drink, nor is it regarded as similar to them. Rather, it is similar to urethra drops, deep head and body wound medication, kohl, enemas and similar medicines which reach the brain or the body but not through the mouth or the nose.

Scholars have differed regarding the invalidation of Sawm through using them.
A group of scholars view that if a fasting person uses any of them, their Sawm is not invalidated.

The other group views that some of these medicines break Sawm while others do not. However, all scholars are of the opinion that taking these medicines is not the same as eating or drinking.

However, if anyone breaks their Sawm by using them, it is considered the same as eating and drinking because all of them reach the stomach voluntarily. It was authentically reported that the Prophet (peace be upon him) said: Sniff water up into the nose deeply, unless you are fasting. He (peace be upon him) excluded the fasting person for fear of water reaching the throat or stomach if one sniffs water strongly which can spoil Sawm. This indicates that everything which reaches the abdomen voluntarily breaks Sawm.

Among the scholars who did not consider Sawm invalid by this were the Shaykh of Islam, Ibn Taymiyyah (may Allah be merciful to him), and other scholars who had the same opinion. They did not validate the analogy between these medicines and food and drink because the evidence does not indicate that nullifiers of Sawm are all that reach the brain, the body, or the stomach, or enter the body through an opening. Thus, as long as there is no Shar`y (Islamic legal) evidence to the effect that nullification of Sawm is conditional on one of these descriptions, it is right to suspend the ruling of invalidation of Sawm in this case. Moreover, deeming these medicines the same as water which reaches the throat or the stomach because of deep sniffing is not correct because they are different. Water is a type of nourishment, and thus if it reaches the throat or the stomach, it spoils Sawm whether it enters through the mouth or the nose which are merely passages. For this reason, Sawm is not invalidated by Madmadah (rinsing the mouth) or careful inhaling of water, as neither of the actions are prohibited. Hence, the mouth being the regular passage has no effect on the ruling. That is to say, if water and the like enter (the throat or the stomach) through the nose it will take the same ruling as entering through the mouth.

Furthermore, in some cases it is used as a nourishing passage, and consequently it is the same as the mouth.

In conclusion, the opinion that seems correct is that inhaling the medicine in question does not break Sawm because, as is mentioned above, it does not fall under the same ruling as food or drink in any aspect.

Van degene die naast iemand zit die rookt en rook binnenkreeg door diegene die rookt, is het vasten niet verbroken. Op dezelfde manier, het rook van de wierrook of het geur ervan ruiken, verbreekt het vasten niet. Voor degene die zelf een sigaret rookt is het anders, want via de sigaret krijgt men kleine stofjes naar binnen en dat verbreekt het vasten van degene die tijdens het vasten rookt.
