    When zakaat al-fitr should be paid:



    Is the time for paying zakaat al-fitr from after the prayer until the end of that day?

    Praise be to Allaah.

    The time for paying zakaat al-fitr does not begin after the Eid prayer, rather it starts after sunset on the last day of Ramadaan, which is the first night of the month of Shawwaal, and it ends with the Eid prayer. The Prophet (peace and blessings of Allaah be upon him) commanded that it should be paid before the prayer. Ibn ‘Abbaas (may Allaah be pleased with him) narrated that the Prophet (peace and blessings of Allaah be upon him) said: “Whoever pays it before the prayer, it is accepted zakaah (i.e., zakaat al-fitr), and whoever pays it after the prayer, it is ordinary charity.” [Narrated by Abu Dawood, 2/262-263, no. 1609; Ibn Maajah, 1/585, no. 1827; al-Daaraqutni, 2/138; al-Haakim, 1/409.]

    It is permissible to pay it one or two days before that, because of the report narrated by Ibn ‘Umar (may Allaah be pleased with him) who said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) enjoined sadaqat al-fitr in Ramadaan.”

    According to another report, they used to pay it one or two days before the end of Ramadaan. Whoever delays it after its time has sinned, and he has to repent for delaying and give it to the poor.

    And Allaah is the Source of strength.

    Ruling on Zakat-ul-Fitr:



    Question 5:

    Is it an authentic Hadith that says: “The Sawm (Fasting) of Ramadan is not raised (to Allah) until Zakat-ul-Fitr (obligatory charity paid before the Festival of Breaking the Fast) is paid”? Is Zakat-ul-Fitr obligatory on a fasting Muslim who is needy and does not have the Nisab (the minimum amount on which Zakah is due) based on the authenticity of the previous Hadith or other Islamic textual evidence authentically reported from the Prophet (peace be upon him)?


    Answer:

    Zakat-ul-Fitr is obligatory on every Muslim who should be self-supporting if he has one Sa‘ (1 Sa‘ = 2.172 kg) or more in excess of his and his family’s need on the day and night of ‘Eid-ul-Fitr (the Festival of Breaking the Fast). This is based on the Hadith authentically reported on the authority of Ibn ‘Umar (may Allah be pleased with them both) who said: The Messenger of Allah (peace be upon him) enjoined the payment of one Sa‘ of dates or one Sa‘ of barley as Zakat-ul-Fitr on every Muslim slave or free, male or female, young or old, and he ordered that it be paid before the people go out to offer ‘Eid Prayer.

    (Related by both Al-Bukhari and Muslim and the wording is that of Al-Bukhari)

    Moreover, Abu Sa‘id Al-Khudry (may Allah be pleased with him) is reported to have said: We used to pay Zakat-ul-Fitr as one Sa‘ of food, or one Sa‘ of dried dates, or one Sa‘ of barley, or one Sa‘ of raisins, or one Sa‘ of curd during the lifetime of the Messenger of Allah (peace be upon him). (Related by both Al-Bukhari and Muslim)

    It will also suffice to discharge the obligation by giving a Sa‘ of the local staple food such as rice and the like. Sa‘ here means the Sa‘ of the Messenger of Allah (peace be upon him), which is four handfuls scooped up with the two hands of an average built man. Accordingly, a person who does not pay Zakat-ul-Fitr is sinful and has to make up for it. With regard to the Hadith you have mentioned, we know nothing to the effect of its authenticity.

    The Food of Az-Zakatul-Fitr:



    Question: What is the food that is permissible to give for Zakatul-Fitr?

    Answer:

    It is reported in the hadith that it is to be given from five things. They are wheat, barley, dried dates, raisins and cottage cheese. However, some of the research scholars have mentioned that specifying these five things was done because they were used at that time. Therefore, they permit giving it from whatever is the common food of the land like rice for example, and corn in the land where it is used as food and so forth.

    Ruling on paying Zakat-ul-Fitr in cash :

    All Praise is due to Allah, the Lord of all the worlds, peace and blessings of Allah be upon His servant and Messenger Muhammad, his family and Companions.

    To proceed: Many of my Muslim brothers asked me about the ruling on paying Zakat-ul-Fitr (obligatory charity paid before the Festival of Breaking the Fast) in cash.


    The answer is:

    It is well-known for every Muslim who has the least discernment that the most important pillar of Islam is the testimony of La ilaha illa Allah (there is no deity but Allah) and that Muhammad is the Messenger of Allah. It is a requisite of "La ilaha illa Allah" that none must be worshipped except Allah alone. Also, a requisite of "Muhammad is the Messenger of Allah" is that Allah (He may be Glorified) must not be worshipped except through what the Prophet (peace be upon him) ordained. Zakat-ul-Fitr is an act of worship according to the Ijma` (consensus of scholars) of all Muslims. The general rule regarding acts of worship is that they are Tawqifiy (bound by a religious text and not amenable to personal opinion). It is not permissible for anyone to perform any act of worship except that which has been ordained by the wise lawgiver (peace be upon him).

    Allah says about him: Nor does he speak of (his own) desire. It is only a Revelation revealed. The Prophet (peace be upon him) said also in this regard: Whoever introduces something into this affair of our which is not of it, it is to be rejected. And: Whoever performs any act for which there is no sanction from our behalf, it is to be rejected. The Prophet (peace be upon him) pointed out that Zakat-ul-Fitr is, as reported in authentic Hadiths, one Sa` (1 Sa` = 2.172 kg) of food, or Sa` of dates, or Sa` of barley, or Sa` of raisin, or Sa` of cheese. Al-Bukhari and Muslim (may Allah be Merciful with them) narrated from `Abdullah Ibn `Umar (may Allah be pleased with them) that he said: Allah's Messenger (peace be upon him) enjoined the payment of one Sa‘ of dates or one Sa‘ of barley as Zakat-Al-Fitr on every Muslim bondsman or free, male or female, young or old, and he ordered that it be paid before going out to offer the Salat-ul-`Eid (the Festival Prayer). Abu Sa`id Al-Khudri (may Allah be pleased with him) said: We used to give Zakat-ul-Fitr in the time of the Prophet (peace be upon him) as one Sa` of food or one Sa` of dates or Sa` (2,172 grams) of barley or Sa` of raisins.

    In another narration: Or Sa` of cottage cheese... Agreed on its authenticity. This is the Sunnah of Muhammad (peace be upon him) regarding Zakat-ul-Fitr.

    It is well known that Muslims at the time of this legislation - especially, the society of Madinah - used to deal in dinar and dirham as they were the circulating currency; however, the Prophet (peace be upon him) did not mention them in Zakat-ul-Fitr. Had everything been acceptable in Zakat-ul-Fitr, he would have explained it because it is not permissible to delay explanation beyond the time of need. Had the Prophet (peace be upon him) ordered this the Sahabah (the Companions of the Prophet) would have reported it (may Allah be pleased with them). As for what has been mentioned that the Zakah (obligatory charity) of Al-Sa'imah (cattle let loose for free pasture) is part of the established compensation provided that there is no Zakah rate that must be paid on it.The general rule in the acts of worship is to take the ruling as it stands. This was mentioned previously. We do not know of any Sahabah of the Prophet (peace be upon him) that paid money in Zakat-ul-Fitr while they were the most knowledgeable of his Sunnah and keenest to adhere to it.

    Had they done so, it would have beed reported as they reported all other matters related to the Shar`i rulings. Allah (May He be Glorified) states: Indeed in the Messenger of Allâh (Muhammad صلى الله عليه وسلم) you have a good example to follow also: And the foremost to embrace Islâm of the Muhâjirûn (those who migrated from Makkah to Al-Madinah) and the Ansâr (the citizens of Al-Madinah who helped and gave aid to the Muhâjirûn ) and also those who followed them exactly (in Faith). Allâh is well-pleased with them as they are well-pleased with Him. He has prepared for them Gardens under which rivers flow (Paradise), to dwell therein forever. That is the supreme success.

    From what have mentioned earlier, it is clear that paying Zakat-ul-Fitr in cash is not permissible or sufficient because doing so contradicts the Shar`i proofs. I ask Allah to grant us success as well as other Muslims to understand His Deen, remain steadfast upon it and warn against that which goes against the Shari`ah for He is the Most Generous. Peace be upon our Prophet Muhammad, his family and his Companions.

    To whom should zakaat al-fitr be paid? :

    Men are asking for zakaat al-fitr in the marketplace, and we do not know whether they are religiously committed or not. There are others whose situation is comfortable, and whatever they get of the zakaah they spend on their children. Some of them receive a salary but they are weak in religious commitment. Is it permissible to give them zakaat al-fitr or not?


    Praise be to Allaah.

    Zakaat al-fitr should be given to poor Muslims even if they are sinners so long as their sin is not something that puts them beyond the pale of Islam. What is meant by poor is those who appear to be poor, even if they are in fact rich. The one who is paying the zakaah should seek out good poor people as much as possible. If he finds out later that the one who took it was actually rich, that does not affect the one who gave it, rather he has discharged his duty, praise be to Allaah.

    And Allaah is the Source of strength.

    To whom should zakaat al-fitr be given?:

    To whom should zakaat al-fitr be given? Is it permissible to send it to the mujaahideen in Afghanistan, for example? Or to donate it to charitable funds for building a mosque, for example?

    Zakaat al-fitr should be given to the poor Muslims in the land or city where it is given, because of the report narrated by Abu Dawood from Ibn ‘Abbaas (may Allaah be pleased with him), who said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) enjoined zakaat al-fitr, to be paid in Ramadaan to feed the poor…” It is permissible to send it to the poor of another land whose people are in greater need. It is not permissible to spend it on building a mosque or other charitable projects.

    Imaam Al-Awzaa’ee (d. 157) said:

    “Adhere to the narrations from those who have preceded,
    even if the people reject you, and beware of the opinions of men,
    even if they beautify it with speech.
    So indeed the afair will become clear (for others),
    while you are upon a straight path regarding it.”

    [Bayhaqee in Al-Madkhal (no. 233) with an authentic chain of narrators].


    He also said:


    “So make yourself patient upon the Sunnah, stop where the people stopped, speak with what they spoke with, and refrain from what they refrained from. And follow the path of your Righteous Predecessors (Salafus Saaliheen) for verily, sufficient for you is that which was sufficient for them.”

    Ibn 'Abbaas verhaalt:

    "Ik bevond mij op een dag achter de Profeet (saw), toen hij zei:
    'Jongen, ik wil je een aantal zaken leren:

    Denk altijd aan Allah , Hij houdt jou altijd in de gaten. Houd je aan Zijn geboden; Hij zal altijd bij jou zijn. Wanneer je wat te vragen hebt, vraag dat dan aan Allah alleen; en wanneer je hulp zoekt, zoek die dan bij Allah alleen. Denk eraan dat als alle mensen zouden samenkomen om jou een of andere gunst te betonen, zij niet in staat zouden zijn jou iets anders te betonen dan dat wat Allah voor jou vastgesteld heeft. En dat indien zij allemaal zouden samenspannen om jou schade toe te brengen; zij niet in staat zouden zijn om jou iets ergers toe te brengen dan dat wat Allah voor jou vastgesteld heeft. De pennen zijn opgeheven en de boeken zijn opgedroogd."

    Hoedhayfah Ibn al-Yaman [Radhiya Allahu ‘anhu] zei:

    “De mensen vroegen de Profeet [sallAllahu ‘alayhi wa salam] gewoonlijk naar de goede dingen, maar ik vroeg hem gewoonlijk naar de slechte dingen, want ik was bang dat zij de macht over mij zouden krijgen. Je zult goed en kwaad in hen zien.” Ik vroeg: “Zal er kwaad na dit goede komen?” Hij zei: “Sommige mensen zullen bij de poorten van de Hel staan en roepen; iedereen die aan hun roep gehoor geeft zal in het Vuur geworpen worden.” Ik zei: “O Boodschapper van Allah [sallAllahu ‘alayhi wa salam], beschrijf hen voor ons.” Hij zei: “Zij zullen van onze eigen mensen zijn en zij zullen onze taal spreken.” Ik vroeg: “Wat raad je mij aan te doen, als ik nog zal leven en dat zal zien?” Hij zei: “Blijf bij de belangrijkste groep [Al-Djama'ah] Moslims en hun leider [Imam].” Ik vroeg: “Wat moet ik doen als er geen belangrijkste groep en er geen leider is?” Hij zei: “Zonder je van al deze sekten af, zelfs als je de wortels van bomen moet eten en je door de dood in dit stadium wordt overmand!” [Saheeh Bukhari, Kitab al-fitnan 9/65

    The tenth question of Fatwa no. 20308 :

    Question 10: Sometimes we give out the soul-purifying Zakat-ul-Fitr (obligatory charity paid before the Festival of Breaking the Fast) to the Fuqaha` (Muslim jurists) following this Madhhab (School of jurisprudence), and at other times to the needy.

    Answer:

    Allah (Exalted be He) has enjoined one sort of Zakah (obligatory charity) to be taken from the wealthy whose property has reached the Nisab (the minimum account on which Zakah is due) or more. This Zakah is taken from the wealthy to be given to the poor and the rest of the eight deserving recipients of Zakah whom Allah (Glorified and Exalted be He) has specified in Surah At-Tawbah, saying: As-Sadaqât (here it means Zakât ) are only for the Fuqarâ’ (poor), and Al-Masâkin (the poor) and those employed to collect (the funds), and to attract the hearts of those who have been inclined (towards Islâm), and to free the captives, and for those in debt, and for Allâh’s Cause (i.e. for Mujahidûn - those fighting in a holy battle), and for the wayfarer (a traveller who is cut off from everything); a duty imposed by Allâh. And Allâh is All-Knower, All-Wise.

    So, if a Muslim has given their Zakah to any of these categories or to the ruler, they shall have fulfilled their duty. A Muslim is also permitted to give some of their Zakah to the ruler and the rest to some of these categories, unless the ruler demands it all. However, it is Munkar (that which is unacceptable or disapproved of by Islamic law and Muslims of sound intellect) and groundless to enjoin the wealthy to give the Zakah twice: once to the ruler and again to any given person like a Faqih (Muslim jurist). This is an unjust act that must be avoided. I have been informed that some people assign an amount of money to be taken from their wealth as a due obligation for the benefit of some shaykh belonging to a Sufi order.

    The amount assigned is one-fifth of one's wealth, and such shaykhs say: This is the fifth of the booty due on people. Also, they regard the properties of Shi`ah (Shi'ites) as Ghanimah (war-booty). Actually all these obligations are void and have nothing to do with the pure Shari`ah (Islamic law). As for the one-fifth which Allah (Exalted be He) has mentioned in the Ayah (Qur'anic verse) that reads: And know that whatever of war-booty that you may gain, verily one-fifth (1/5th) of it is assigned to Allâh, and to the Messenger, and to the near relatives [of the Messenger (Muhammad صلى الله عليه وسلم)], (and also) the orphans, Al-Masâkîn (the poor) and the wayfarer it refers to a one-fifth of the properties Muslims take from the Kafirs (disbelievers) as a Ghanimah after defeating them.

    This amount of wealth is distributed by the ruler who is (supposed to be) the commander of the believers or the king of the state who led the war against the Kafirs, or by his deputy to the recipients mentioned in the Ayah and for the public interests exactly like the way of distributing the Fay' (booty gained without engagement in war). So judges, teachers and Muslim soldiers are given an amount from it that would help them dedicate themselves to their jobs as explained by scholars on the issue of the recipients of Fay' and the one-fifth of the Ghanimah.

    This means that all Muslim sects have to submit to the Islamic laws on all affairs: on the issues of Zakah, Fay', Ghanimah and so on. They are not allowed to deviate from the Muslim mainstream by innovating rulings which have nothing to do with the Islamic Shari`ah, as this constitutes a breach of the rulings of Shari`ah and opposition to Allah (Exalted be He), His Messenger (peace be upon him) and Muslims. It further creates a gap between Muslims which sows dissension and contention. This would eventually harm Muslims and help their enemy to prevail over them.

    Zakat-ul-Fitr has to be given to the poor and needy, as Ibn Abbas (may Allah be pleased with him and his father) is reported to have said: The Messenger of Allah (peace be upon him) ordained Zakat-ul-Fitr as a purification from idle or indecent talk for those observing Sawm (Fast), and as food for the needy. He (peace be upon him) further prescribed it to be given before going out for Salat-ul-`Eid (the Festival Prayer). It is also permissible to give it one or two days before the day of `Eid, as it has been authentically reported that the Sahabah (Companions of the Propeht) used to give it to the poor one or two days before the day of `Eid. Allah is the One sought for help and guidance to the right path.

    May Allah grant us success! May peace and blessings be upon our Prophet Muhammad, his family, and Companions!

    Aicha [radhiya Allahu ‘anha] zei:

    “Ik hoorde de Profeet [sallAllahu ‘alayhi wa salam] zeggen: ‘De dag en de nacht zullen niet voorbijgaan tot de mensen Laat en ‘Uzza [twee godinnen uit het preïslamitische Arabië] beginnen te aanbidden.’ Ik [radhiya Allahu ‘anha] zei: “O Boodschapper van Allah, ik dacht dat toen Allah de ayah: ‘Hij is het Die Zijn Boodschapper gestuurd heeft met leiding en om de godsdienst van de waarheid over alle andere godsdiensten superieur te maken, zelfs als de polytheïsten het haten.’ [Surah At-Tawbah, ayah 33] Dat dit betekende dat [deze belofte] vervuld zou worden.”

    De Profeet [sallAllahu ‘alayhi wa salam] zei: “Het zal zo gebeuren als Allah het wenst. Dan zal Allah een prettige wind sturen, die een ieder die zelfs maar het geloof ter grootte van een mosterdzaadje in zijn hart heeft, zal meenemen. Slechts degenen zonder goedheid in hun hart zullen achterblijven en zij zullen tot de religie van hun voorvaderen terugkeren.” [Saheeh Muslim, Kitab Al-Fitan 8/182]
